Research on Intermediary Liability and Free Speech

Prof. Indranath Gupta received grant from the Facebook India Online Services Pvt. Ltd. This project will cover issues like increased expectations surrounding the use of tools, the existing policy and legal developments surrounding the expectations of Intermediaries in India and Europe, and the future implications on all the stakeholders if issues like proactive monitoring is mandated by policy. The project concludes on a note that proactive monitoring by online intermediaries to reduce cases of copyright infringement on their platforms is not the optimal way ahead to cater to the innovation ecosystem. In the process, the project will consider the Information Technology Act, Copyright Act, the existing and Draft Guidelines for intermediaries in India, the Judgements delivered by various Courts in India, and the EU Directives and Judgements of the Court of Justice of the European Union.
