The Plaintiff, irked by this filed a suit in the Delhi High Court contending that a license with respect to these properties is irrevocable and perpetual. The Defendant in turn questioned the maintainability of such suit on the basis of an arbitration clause in the license agreement.<\/p>\n\n\n\n<p id=\"f4std\"><strong>Issues<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\" id=\"5pjd4d16kkk9ot1983\">\n<li>Whether an objection can be made under <a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_3_46_00004_199626_1517807323919&amp;orderno=8\" target=\"_blank\" rel=\"noreferrer noopener\">Section 8<\/a> of the Arbitration and Conciliation Act, 1996 (\u201cAct\u201d) without filing an application?<\/li>\n\n\n\n<li>Whether the Court can decide whether a matter under the amended Section 8 is arbitrable once an objection is taken?<\/li>\n\n\n\n<li>Whether the Court can refer claims which relate to a special statute or are related to disputes <em>in rem <\/em>to arbitration?<\/li>\n\n\n\n<li>Whether seeking ownership rights in the shops\/spaces is barred under <a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_3_46_00004_199626_1517807323919&amp;orderno=38\" target=\"_blank\" rel=\"noreferrer noopener\">Section 34<\/a> of the Specific Relief Act?<\/li>\n<\/ol>\n\n\n\n<p id=\"9j88r\"><strong>Analysis<\/strong><\/p>\n\n\n\n<p id=\"cjrki\">With respect to the first issue, the Court looked at <a href=\"http:\/\/164.100.69.66\/jupload\/dhc\/MMH\/judgement\/16-01-2018\/MMH15012018S1252017.pdf\" rel=\"noreferrer noopener\" target=\"_blank\"><em>Parasramka Holdings Pvt. Ltd. <\/em>v.<em> Ambience Pvt. Ltd. <\/em><em>and another<\/em><\/a> where it was clearly held that there was no need for any filing of a formal application under Section 8. In this case the Court. followed the judgment given in <a href=\"https:\/\/main.sci.gov.in\/judgment\/judis\/37919.pdf\" rel=\"noreferrer noopener\" target=\"_blank\"><em>Booz Allen &amp; Hamilton Inc. <\/em>v.<em> SBI Home Finance Limited &amp; Ors.<\/em><\/a> and stated that this is applicable till an objection is filed in the written statement challenging the maintainability of the suit in view of the arbitration clause in the agreement.
