“This is a case of elopement of two people, who were in love, where unfortunately the victim girl is a minor”: Andhra Pradesh High Court

A single-judge bench of the Andhra Pradesh High Court has granted bail in a POCSO case where upon prima facie review, the court concluded that the survivor and accused are a couple who have eloped. In this case, a sixteen-year-old girl and a twenty-one-year-old man married in a temple. The complainant was the survivor’s father. The survivor ingested poison when her family denied her permission to get married to the accused. After that, the couple eloped. The accused was charged under Sections 366 and 376 of the Indian Penal Code, Sections 4 and 17 of the Protection of Children from Sexual Offences Act, 2012 and Section 10 of the Prohibition of Child Marriage Act, 2006. Owing to the consistent narrative of consent of the survivor regarding the lack of inducement or coercion, the court has enlarged the accused on bail. (CRIMINAL PETITION No. 1043 of 2024)
