“Allahabad High Court Halts Arrest of School Teacher Accused of Alleged Religious Conversion Attempt and Sexual Coercion”

In a recent legal development, the Allahabad High Court has intervened in a controversial case involving allegations against a school teacher. The case, originating from an FIR registered as Case Crime No. 83 of 2023 at Police Station Cantt, Eastern Commissionerate Kanpur Nagar, District Kanpur Nagar, centers around accusations against a teacher at a prominent school where the son of the complainant is a student in Class X.

According to the FIR, the teacher is accused of pressuring the complainant’s son to engage in a sexual relationship and attempting to induce him to convert to Christianity. These allegations have led to charges under various sections of the law, including Section 506 of the Indian Penal Code, Sections 3 and 5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021, and Sections 9, 10, and 23 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).

Responding to a petition filed by the accused teacher and two others implicated in the case, the High Court issued an interim order of significance. The Court directed that no coercive action, including arrest, be taken against the petitioners until further legal proceedings are completed. This stay order effectively suspends immediate police action based on the FIR.

Furthermore, the High Court mandated the Commissioner of Police, Kanpur, to transfer the investigation to the cyber cell. This step aims to investigate whether the student involved might have created fake accounts using the teacher’s mobile phone or ID, potentially influencing the events leading to the filing of the FIR.

The Court’s decision to transfer the investigation underscores its cautious approach to the case, recognizing the complexity and sensitivity of the allegations. This move also reflects a commitment to thoroughly explore all aspects of the matter before reaching a definitive conclusion. The case is set for its next hearing on July 10, indicating ongoing judicial scrutiny into the allegations and surrounding circumstances.

The interim protection granted by the Allahabad High Court not only shields the petitioners from immediate arrest but also paves the way for a detailed examination of the evidence and legal arguments in subsequent proceedings. This development marks a crucial juncture in a case that has attracted public attention due to its serious nature and potential implications for both the accused and the legal framework surrounding such allegations.
