“Avlambam Fund Scheme- Delhi High Court orders implementation of grant to victims of Acid attack.”

The case was referred to the Division Bench owing to the grave allegations of rape and forcible ingestion of toilet cleaner by the victim a minor child. 

Acid attacks are widely regarded as one of the most heinous forms of violence, explicitly acknowledged under Section 124 of the Bharatiya Nagarik Sanhita, 2023 (BNS). Furthermore, Section 396 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) imposes an obligation on both State and Central governments to establish and adequately fund victim compensation schemes, ensuring support and rehabilitation for survivors.

The victim in this case has undergone several critical medical procedures, including a tracheostomy         (a surgical intervention to create an opening in the trachea to facilitate breathing). Additionally, the child requires a specialized diet to support their recovery. The family has been facing severe financial strain, as the compensation awarded thus far has been deemed inadequate to cover the extensive medical expenses and associated costs. In light of these circumstances, the court has sought a response from the Government of the National Capital Territory of Delhi (GNCTD) regarding the insufficiency of the compensation provided.

The GNCTD, through its standing counsel, has shared a draft scheme with the Registrar General of the High Court, legal representatives of victims, and the Amicus Curiae to enhance support mechanisms for acid attack survivors. The finalized scheme establishes a permanent corpus fund of Rs. 10 Crore to provide sustainable assistance and rehabilitation to acid attack survivors. The scheme sanctioned by GNCTD will be administered by the Principal District & Sessions Judge.
