The Kerela High Court had convicted a father, native of Tamil Nadu for sexually exploiting his minor daughter aged 14 years while residing in a house in Thiruvananthapuram during the Covid times. After analysing all of the available data, it can be said that the prosecution was successful in showing, through PW1’s deposition, that the accused, who is her father, repeatedly subjected her to aggravated sexual assault and, as a result, committed offences that are punishable under section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015, section 10 read with 9(n), and section 10 read with 9(l) of the Protection of Children from Sexual Offences Act.
The precise allegation was that the accused, while living in a leased property in Thiruvananthapuram, repeatedly sexually assaulted the minor daughter by touching her private parts with intent. The victim’s mother passed away nine years prior, and during the Covid period, her other siblings were residing in Tamil Nadu with their maternal grandmother. Only in 2023 did the young victim tell her class instructor about the sexual assault because she was afraid no one would be there to support her. The minor victim was considered by the court to be a trustworthy and genuine witness who gave consistent testimony about the accused’s sexual abuse of her. Based on PW1’s deposition, the Court found that the accused touched PW1’s vagina and breast numerous times during the Covid period in 2020 and on February 15, 2023, at her leased home. The accused, who was the minor daughter’s guardian, was charged by the court of serious sexual assault and of taking advantage of her helplessness and poverty. According to the statement, the accused committed the crime when the minor daughter moved in with him and had no one else to provide for her. It declared that the accused should get the harshest punishment possible in order to send a clear message to society.
