A single-judge bench of the Bombay High Court refused to grant bail in a POCSO case about a gang rape of a 15-year-old child. The accused claimed that despite detention since 2020, the charges had not yet been framed. The accused claimed bail due to the prolonged incarceration. The survivor consented to the bail in court. The court noted that prolonged incarceration cannot be a reason to grant bail due to the seriousness of the offence in question. Moreover, the court directed the trial court to complete the trial within 9 months. The court noted that the survivor consenting to bail showcases the pressures being inflicted upon the child. The court directed a speedy trial to prevent influence upon the witness and tampering with evidence. (CRIMINAL BAIL APPLICATION NO. 1443 OF 2023).
