High Court recently reaffirmed the severity of child abuse, emphasizing its profound impact on victims’ mental, emotional, and physical well-being. In a case dating back to 2010, the Court upheld the conviction of Subhas Mondal for attempting to outrage the modesty of a 10-year-old girl. Justice Shampa Dutt underscored the grave violation of children’s rights and stated that “Child abuse is a grave violation of children’s rights and wellbeing, encompassing physical, emotional, sexual, or neglectful harm inflicted by adults or peers. It scars victims mentally, emotionally, and physically, often leading to long-term consequences. Early recognition, prevention, and intervention are crucial in safeguarding children and promoting their safety, health, and development”. Mondal was found guilty of hugging the victim from behind and touching her inappropriately and despite his claim of no intention to outrage modesty, the Court deemed his actions reprehensible. While unable to apply the POCSO Act retrospectively, the Court upheld the trial court’s decision, sentencing Mondal to two years of rigorous imprisonment and a fine. This verdict reinforces the imperative to protect children from harm and seek justice for victims of abuse. [Citation: CRA 323 of 2016]Click here to read/download the order
