“Grandparents Can’t Be Denied Visitation Rights To Meet Child, Affectionate Relationship With Them Beneficial For Grandkids”: Madras High Court

A single-judge bench of the Madras High Court provided visitation rights to grandparents for the beneficial interest of the child. The appeal was instituted by the mother of the child. After the father of the child passed away, the mother of the child and grandparents were in a tussle for custody and visitation. The court left the question of custody and facts open for adjudication by the trial court. The trial court had provided visitation rights to the grandparents by allowing them to meet the child for 2 hours on 2 Saturdays of the month. The Court modified the order to provide visitation rights to one Saturday in a month for 4 hours by citing the best interest of the child doctrine underpinning the guardianship act.
