Delhi High Court: Matrimonial disputes don’t justify involving minor children despite marital difference

The Delhi High Court has deemed a wife’s attempt to turn her children against their father as “parental alienation,” constituting “grave mental cruelty.” A division bench highlighted that marital differences don’t justify involving minor children in disputes. Granting divorce to a husband based on cruelty by the wife under the Hindu Marriage Act, the court noted that despite the wife’s education, she couldn’t manage her emotions, making baseless allegations of adultery. The bench emphasized that involving their eight-year-old daughter in disputes was irrational and cruel. The court condemned the wife’s conduct of making unsubstantiated allegations and involving their child in their disputes, terming it extreme cruelty and a clear case of parental alienation. The bench concluded that the wife’s non-reconciliatory attitude, withdrawal from the husband’s company, and baseless accusations amounted to mental cruelty, leading to the dissolution of the marriage.
