Summary of Law Commission of India Report No. 283 on Age of Consent under the POCSO Act 2012
The Law Commission of India received a reference from the Hon’ble High Court of Karnataka in 2022 and from High Court of Madhya Pradesh in 2023 requesting the Commission to rethink the age criteria for sexual consent, taking into consideration the rising number of cases relating to minor girls above the age of 16 years falling in love, eloping and having sexual intercourse with the boy, thereby attracting the provisions of the Protection of Children from Sexual Offences Act 2012 (“POCSO”) and/or the Indian Penal Code, 1860 (“IPC”). The document summarizes the suggested amendments along with the rationale behind the suggestions.

This publication is produced and created by the Child Rights Clinic, JGLS and is available for educational and developmental purposes.This document contains analysis of crimes against children based on the report released by the National Crime Bureau in 2022 crime in India report. The report shows a 8.7% increase in crimes against children from 2021. Also, 2022 had the highest record in crimes against children last five years. This document tracks crimes against children from 2018-2022 as per NCRBC reports.
