{"id":1522,"date":"2019-10-23T05:38:39","date_gmt":"2019-10-23T05:38:39","guid":{"rendered":"http:\/\/jgu.edu.in\/blog\/?p=1522"},"modified":"2019-12-11T05:41:07","modified_gmt":"2019-12-11T05:41:07","slug":"urgent-need-for-mandatory-compensation-and-immunity-for-victims-in-india-ravi-nair-executive-director-south-asian-human-rights-documentation-centre","status":"publish","type":"post","link":"https:\/\/jgu.edu.in\/blog\/2019\/10\/23\/urgent-need-for-mandatory-compensation-and-immunity-for-victims-in-india-ravi-nair-executive-director-south-asian-human-rights-documentation-centre\/","title":{"rendered":"&#8220;Urgent Need for Mandatory Compensation and Immunity for Victims in India&#8221; Ravi Nair, Executive Director, South Asian Human Rights Documentation Centre"},"content":{"rendered":"\n<p><strong>Sonipat, Haryana: \u201c<\/strong>There is an urgent need for mandatory implementation of compensation and official immunity to facilitate victim aid in India,\u201d said Mr. Ravi Nair, Executive Director, South Asian Human Rights Documentation Centre at the 8th International Conference on Victim Assistance held at Jindal Institute of Behavioural Sciences (JIBS).The two-day International Conference on Victim Assistance was being held at Jindal Global University (JGU) in Sonipat, Haryana on 21-22 October. <\/p>\n\n\n\n<p>Terming victimology in India as the curious osmosis of a\nstate-centric and more citizen-focused science, Ravi Nair, Executive Director\nof the South Asia Human Rights Documentation Centre (SAHRDC), has called for\ndeveloping improved methods for relief to victims in the country. <\/p>\n\n\n\n<p>Mr. Nair whilst speaking at The Centre\nfor Victimology and Psychological Studies (CVPS) of Jindal Institute of\nBehavioural Sciences (JIBS) during the 8<sup>th<\/sup>&nbsp;International\nConference on Victim Assistance stressed on the need for implementation of\nmandatory compensation for victim aid in India. \u201cWe need to take to take a cue\nfrom Indonesia in implementing mandatory compensation and official immunity in\na bid to facilitate victim aid in the country,\u201d Nair said.<\/p>\n\n\n\n<p>The Conference witnessed participation\nof eminent scholars from India and abroad in presence of Prof. (Dr.) YSR\nMurthy, Registrar, OPJGU and Prof. (Dr.) Sanjeev P. Sahni, Principal Director,\nJIBS.<\/p>\n\n\n\n<p>Referring to the success of the\nconference in nurturing critical thinking and encouraging a network of\nvictimologists around the world. &nbsp;<strong>Dr. Sanjeev P. Sahni&nbsp;<\/strong>said,\n\u201cWe organise this conference every year and have reached its 8<sup>th<\/sup>\nedition. The conference is gaining popularity and rigour with every passing\nyear. We have seen an increased interest as never before this year with more\nthan 550 registrations and about 250 abstracts for presentation.\u201d Dr. Sahni\nacknowledged the contribution of Professor (Dr.) Chokalingom, Prof. GS Bajpai,\nProfessor (Dr.) Jaishankar, Prof. (Dr.) Beulah Shekhar Prof.&nbsp; and (Dr.) C.\nRaj Kumar, Founding Vice-Chancellor of JGU, towards promoting dialogue in\nvictimology in India.<\/p>\n\n\n\n<p>Dr Sahni while appealing Psychologists\nand other Mental Health Professionals to come forward and apply the scientific\nacumen on Victimology studies, proposed joint workshops to be held by JIBS on\nVictim Assistance where students can participate with other delegates related\nto the criminal justice system. \u201cThe main theme of workshop will discuss and\nprovide resolution towards victim assistance,\u201d he said.<\/p>\n\n\n\n<p>Dr. Sahni also projected the\nincreasing popularity of the helpline introduced by JIBS for psychological\nassistance. \u201cStudents have started sharing their problems with their parents\nand now assistance is requested by parents, dialing 1800-213-1210,\u201d he said.<\/p>\n\n\n\n<p>Mr Pankaj Kumar Singh- IPS, Additional\nDirector General CBI, Ministry of Department of Personnel &amp; Training\n(DOP&amp;T), Rajasthan police during the conference chaired a session on Victim\nCompensation and Criminal Justice System. Mr. Singh built his argument rooted\nin the historical desire to avoid grudges and maintain peace, by ensuring that\nthe victim gets a place in the justice system. He questioned on position in the\ncontemporary world where the victim is often forgotten, and the perpetrator\nbecomes the focal point instead. <\/p>\n\n\n\n<p><strong>Dr. G. K. Goswami, <\/strong>IPS (Deputy\nDirector, CBI) also chaired a session on Secondary Victimization and expressed\nconcern over no specific study on wrongful convictions in India. Dr. Goswami\nfocused on the Report&nbsp;No. 277 of Law Commission of India published in\nAugust 2018 stating legal remedies for wrongful prosecution (miscarriage of\njustice). He also mentioned the LCI observation, i.e. \u2018Factual Innocence\u2019 is\nvery difficult to prove, and wrongful conviction is too high a standard to\naddress in India. Dr. Goswami asserted in his talk that DNA testing is a potent\ntool not only to identify the guilty, but also to protect the innocent.<\/p>\n\n\n\n<p>Professor (Dr.) Beulah Shekhar, Head\nDepartment of Criminology &amp; Criminal Justice, Manonmaniam Sundaranar\nUniversity and Professor (Dr.) Dick Andzenge, from St. Cloud State University,\nUSA also chaired sessions on \u2018Advances in Victimology\u2019 and \u2018Voiceless victims\u2019\nrespectively.<\/p>\n\n\n\n<p>In a session on \u2018Victim Assistance\u2019, Dr. P. M. Nair, IPS (Retd.)\nChairperson, Centre of Excellence and Centre of Research and Learning (CORAL)\nhighlighted the main hindrances in criminal justice system. \u201cWe go by the\nnumber of trafficking and the number of rescues done by the NGOs, but there is\nhistory of rescuing the same victim from different places in different times,\nwhich reflect the inefficiency and increased vulnerability,\u201d he said.<\/p>\n\n\n\n<p>The two-day conference deliberated\nextensively on the multiple issues around Victims assistance: Victims\u2019 Rights\nand the Criminal Justice System, Violence within Family, Sex, Gender and\nSexuality (including violence against LGBTQ), Role of NGOs, Violence Against\nWomen and Children, Media and Cyber Victimization, Human Trafficking and\nVictimization of Immigrants. <\/p>\n\n\n\n<p>40 papers were presented by eminent\nbehavioural scientists and \u2018Victimology and Psychological Studies\u2019 scholars\nfrom across the globe.
