Ravindra Bhat<\/strong><\/p>\n\n\n\n<p><strong>Boeing\ncommitted to support the Make in India campaign, only a matter of time before,\nF\/A-18 Super Hornet can be manufactured in the country &#8211; Dr. Akhil Prasad,\nCountry Counsel, Boeing India<\/strong><\/p>\n\n\n\n<p><strong>Any dilution in existing IPR framework will make\nthe existing ecosystem counter-productive hindering the growth of Indian\nbusinesses\u201d &#8211; Dr. Sheetal Gupta, India Lead \u2013 IPR<\/strong> <strong>Advocacy, Ericsson India<\/strong><\/p>\n\n\n\n<p>The\ndraft version of the Indian government\u2019s forthcoming National IP Policy has\nstated that the government ought to devise \u2018a strong, balanced, predictable and\ntransparent IP regime\u2019, and that foreign companies must be encouraged to bring\ntheir IP-protected inventions and creations to India along with investment and\ntechnology transfer and establish their manufacturing, R&amp;D and outsourcing\nbases in India. There has been a long drawn debate on the interface between IP\nand competition law, which has also received much scholarly attention and\nscrutiny.<\/p>\n\n\n\n<p>To\npromote research and high-level dialogue on such issues, the Jindal Initiative\non Research in Intellectual Property and Competition (JIRICO) brought together\nleading public policy academics, practitioners, researchers, lawyers and\ngovernment officials from India and abroad to participate in a two-day workshop\non \u2018Standard Setting and Innovation in the Information and Communication\nTechnology (ICT) sector\u2019, in Delhi on December 18 and December 19, 2015.<\/p>\n\n\n\n<p>The\nworkshop deliberated on crucial and inter-related issues of the draft National\nIP policy and the interface between law, economics and public policy. The aim\nof the workshop was to help promote research and high-level dialogue on such\nissues.<\/p>\n\n\n\n<p>The\nevent was inaugurated by <strong>Mr. Nalin kohli, National Spokesperson of the BJP<\/strong>.\nMr. Kohli expressed hope that Initiatives like, \u201cMake in India\u201d and \u201cDigital\nIndia\u201d will transform India not only into a global design and manufacturing hub\nbut also empower every citizen with access to digital services, knowledge and\ninformation. He further emphasized that, &#8220;The two programmes are critical\nand have tremendous potential of bringing far reaching and structural changes\nin India&#8217;s economic growth.\u201d<\/p>\n\n\n\n<p>Speaking\non the occasion, <strong>Professor (Dr.) C Raj Kumar, Vice Chancellor, O.P. Jindal\nGlobal University<\/strong>, said, \u201cThe Jindal Initiative on Research in IP and\nCompetition (JIRICO) is a very special project and part of a larger effort to\nbe engaged in public policy making and also part of the evolution of new\npolicies in the best interest of the country. Under\nthis project, we hope to bring together experts, researchers and policy makers\nto engage in a meaningful conversation that will shape some of the central and\ncritical issues in the interface of Intellectual property rights as well as\ncompetition law in the country. I am hopeful that your deliberations and\ndiscussions today, will help start that conversation on the right note.\u201d<\/p>\n\n\n\n<p>Delivering\na special address at the forum <strong>Hon\u2019ble Justice Mr. S. Ravindra Bhat, Judge,\nDelhi High Court<\/strong>, called for creating a balanced regulatory environment in\nthe IPR sector, he said, \u201cThe teleological underpinnings of Intellectual\nProperty Rights (IPRs) largely remain constant, finding the right balance\nbetween promotion, securing innovation and creativity amidst the danger of\noverprotection is the need of the hour.\u201d Justice Bhat also noted, \u201cThe interpretation\nof the issues and concept of IPR is extremely rudimentary in our country and,\ntherefore, we do not see a unified structure in regulation.\u201d<\/p>\n\n\n\n<p>Speaking\non the occasion <strong>Ms. Pratibha Singh, Senior Advocate and Member, National IPR\nThink Tank<\/strong>, said, \u201cThe IPR jurisprudence in India is evolving in a very\nbalanced manner and the forthcoming years should see the country taking a lead\nin these matters.\u201d<\/p>\n\n\n\n<p>The\nkey theme of the two day workshop was set around the subject of standard\nsetting and innovation in the ICT sector and core discussions revolved around\nboosting the innovation climate in India, IP, competition and innovation\nchallenges in the ICT sector as well as issues in standard setting.\nParticipants were invited to evaluate such critical issues and to introspect\ninto the best practices, in an international backdrop.<\/p>\n\n\n\n<p>Speaking\non the need to boost the innovation climate in the country during the first\nsession, <strong>Dr. Shamnad Basheer, Honorary Research Professor of IP Law, Nirma\nUniversity and Founder of Spicy IP blog<\/strong> said, \u201cTo question the process of\ninnovation in the intellectual property sector, quintessentially refers to a\nparadox. The IP regime framework in the country is resistant to change and\nlargely non-innovative and there is a significant need to rescript this\nnarrative.\u201d<\/p>\n\n\n\n<p><strong>Dr.\nAkhil Prasad, Country Counsel, Boeing<\/strong>, said,\n\u201cIndia has very strong laws on intellectual property rights and Boeing does not\nsee a threat of violation of these rights in the country, I believe the country\nhas modern IPR laws and is at par with global standards.\u201d Speaking\non the Make in India initiative, he said, \u201cBoeing is committed to support the\nMake in India campaign and it is only a matter of time before our signature\naircraft, the F\/A-18 Super Hornet can be manufactured in the country. India is\none of our biggest markets outside the United States and we want to manufacture\nmost of our products in the country.\u201d<\/p>\n\n\n\n<p>&#8220;Entry\nand continued growth of Indian businesses besides exponential consumer demand\nfor standardised devices is evident of the fact that FRAND assured Standard\nEssential Patents have played a key role in promoting competition, generating\nemployment and Entrepreneurship in the ICT domain. Thus, any dilution in\nexisting IPR framework will make the existing ecosystem counter-productive\nhindering the growth of Indian businesses\u201d, said <strong>Dr. Sheetal Gupta, India Lead \u2013 IPR<\/strong> <strong>Advocacy, Ericsson India<\/strong>.<\/p>\n\n\n\n<p>The\nother distinguished speakers who chaired sessions in the workshop and spoke\ntherein were Dr. Geeta Gouri, Former Member, Competition Commission of India,\nMr. Sandeep Bhargava, Executive Vice President, Corporate Affairs &amp; Public\nPolicy, Vodafone India Limited, Mr. Pravin Anand, Managing Partner of Anand\n&amp; Anand, Dr. Shubha Ghosh, Professor, University of Wisconsin Law School\n(USA), Dr. Shubhashis Gangopadhyay, Professor, Shiv Nadar University and Dr.\nJay Kesan, Professor, University of Illinois Law School (USA).&nbsp; <\/p>\n\n\n\n<p><strong>About\nJindal Initiative on Research in IP &amp; Competition (JIRICO)<\/strong><\/p>\n\n\n\n<p>JIRICO, an initiative of JGU,\nwill focus on initiating and complementing well-informed policy related\ndeliberations that can result in concrete reforms.
